Doze organizações não-governamentais com atuação na Amazônia fazem nota de desacordo sobre acordo anunciado pelos ministro do Meio Ambiente e da Agricultura que reduz proteção da Amazônia. A seguir, a íntegra do documento:

Acordo anunciado pelos Ministros do Meio Ambiente e da Agricultura reduz proteção da Amazônia e rompe compromisso público de Minc
Contrariando seu discurso de posse, quando afirmou que o Presidente Lula não permitiria a redução da Reserva Legal na Amazônia, o Ministro do Meio Ambiente, Carlos Minc, anunciou acordo com o Ministro da Agricultura, Reinhold Stephanes, para possibilitar que os produtores rurais possam fazer a recuperação da reserva legal com espécies exóticas. Isso significa na prática a redução da reserva legal de 80% para 50% na Amazônia, pois monoculturas de espécies exóticas não cumprem a função ecológica prevista no Código Florestal.
A proposta é a mesma do projeto de lei 6424/05, conhecido como Floresta Zero, de autoria do Senador Flexa Ribeiro, por permitir bacias hidrográficas sem cobertura florestal. A possibilidade de compensação de reserva legal em outra bacia hidrográfica desestimula a recuperação de áreas degradadas e mantém o cenário de desequilíbrio ambiental promovido pelos desmatamentos.
Consideramos fundamental que qualquer discussão ou negociação em torno do Código Florestal seja feita de forma transparente e com participação da sociedade civil e da comunidade científica. Esse debate precisa levar em conta os demais biomas brasileiros, igualmente importantes.
Aprimorar o Código Florestal, na lógica de otimizar o uso de áreas desmatadas e impedir novos desmatamentos, é uma perspectiva positiva do ponto de vista socioambiental. Para tanto, é fundamental que as mudanças consolidem um entendimento comum de valorização da floresta.
As entidades abaixo assinadas reconhecem que é indispensável para o país promover o desenvolvimento econômico sustentável e a geração de empregos. Combinar esses fatores à conservação e recuperação dos recursos naturais, garantindo a integridade dos ecossistemas é nosso desafio.
A crise climática global e o papel dos desmatamentos na emissão de gases de efeito estufa exigem uma postura enérgica de controle dos desmatamentos e manutenção dos ativos florestais existentes no País. Recente estudo divulgado pela Embrapa sobre “Aquecimento global e a nova geografia da produção agrícola no Brasil” demonstra que o aquecimento global deve alterar profundamente a configuração da agricultura no Brasil e provocar perdas de R$ 7 bilhões.
Infelizmente, no governo Lula, vale a máxima de Schelling: 'não existe absurdo que não encontre o seu porta-voz'.

O atual código florestal Brasileiro estabelece a necessidade de que cada propriedade rural tenha uma área mínima de florestas e outros ecossistemas naturais conservados. Essa área mínima é a soma das áreas de preservação permanente (como topos de montanha, margens dos rios, lagos e outros cursos d’água) e a área chamada Reserva Legal. A função da Reserva Legal é de manter dentro de cada propriedade, uma percentagem mínima de vegetação nativa, que cumpre uma importante função ecológica como habitat para a biodiversidade e fornece diversos serviços ambientais como o estoque de produtos florestais, controle de pragas e incêndios, melhoria da produção de água; na proteção do solo e corpos d’água evitando erosão e assoreamento; e captação de carbono da atmosfera.
A legislação brasileira estabelece que a área de reserva legal deva ser de 80% na Amazônia Legal, 35% na região de Cerrado que esteja nos estados da Amazônia Legal e 20% nas demais regiões do país.
A grande maioria das propriedades rurais brasileiras não possui as áreas de preservação permanente (APPs) e de reserva legal (RL), conforme determina o código florestal. O PL 6424 é uma tentativa de estimular os proprietários rurais a regularizarem sua situação perante o código florestal. A legislação brasileira atual já prevê, em alguns casos específicos, mecanismos de compensação, onde o proprietário compensa o dano ambiental causado em sua propriedade por meio de aquisição direta de uma área com vegetação nativa em região próxima à sua propriedade ou através de cotas de reserva florestal.
